catcher of clams from marketing his own catch without a
shipper's or dealer's license.

(c) Clam Taxes. Every clam dealer shall pay a special tax
of five cents (5) per thousand or fractional part thereof on all
clams sold or marketed by him, and shall remit said tax weekly
to the Department of Tidewater Fisheries or to a local officer
representing said Department.

(d) Disposition of Clam Receipts. All monies received by
the Department of Tidewater Fisheries for licenses, fees, or
taxes shall be transmitted by said Department to the State
Comptroller for deposit to the credit of the oyster fund.

15. OYSTER FUND.

All moneys received by the Comptroller of the Treasury,
under the provisions of this Article, from license fees, taxes,
fines, penalties, forfeitures, or any other source,, shall be
credited by said Comptroller to the Oyster Fund.

16. PENALTIES.

General Provisions. Whenever the word "Court" or "Courts"
is used in this section it shall mean and include any Circuit
Court of the Tidewater Counties, the Criminal Court of Balti-
more City, any Trial Magistrate of the said Counties or City, or
any Justice of the Peace having criminal jurisdiction in any of
the said Tidewater Counties, provided such Court, Trial Magis-
trate or Justice of the Peace has jurisdiction over the alleged
violator.

Any of the above mentioned Courts shall have jurisdiction
to hear and determine any criminal proceeding brought
against any person for the violation of the provisions of this
Article in the event that said violations occurred or were com-
mitted in or on the waters of the Chesapeake Bay, as defined
in sub-section (j), Sec. 1 of this Article, title "Definitions".

If the said violation occurred in or on county waters, as
defined in sub-section (i) of said Sec. 1, the Courts having
jurisdiction in the county where the violation occurred shall
have jurisdiction thereof.

When the word "person" is used in this section it shall have
the meaning defined in sub-section (m) of said Sec. 1.

In all criminal proceedings arising from the violation of
any of the provisions of this Article the defendant shall have
the right to appeal in the same manner and to the same extent
that defendants now have in case of convictions for misde-
meanors.

(a) Culling. Any person violating the provisions of Sec.
4 of this Article shall be guilty of a misdemeanor, and
