SECTION 1. Be it enacted 'by the General Assembly of Mary-
land, That five new sections be and they are hereby added to
the Montgomery County Code (1939 Edition—being Article 16
of the Code of Public Local Laws of Maryland) title "Mont-
gomery County", to be under sub-title "Purchasing Bureau",
said new sections to be known as Sections 830 to 834, inclusive,
to follow immediately after Section 829 of said Code and
Article, and to read as follows:
830. There is hereby created and established a Purchasing
Bureau for Montgomery County, the head of which shall be a
Purchasing Agent to be appointed by the County Commis-
sioners of said County for a term of four years, the said Pur-
chasing Agent shall receive such salary and have such assist-
ants and clerks as the said County Commissioners shall de-
termine from time to time. The said Purchasing Agent shall
furnish a fidelity bond to said Board of County Commissioners
in the penalty of $25, 000.
831. (a) Every department, board, commission, bureau,
division, institution and agency of the County, and every other
duly authorized agency of Government, except the Liquor Con-
trol Board, that spends for the purchase of supplies, money
raised by the annual tax levy of the Board of County Commis-
sioners against the taxable property of Montgomery County,
hereinafter called the using authorities, shall purchase all ma-
terials, supplies and equipment, through or with the approval
of the Purchasing Agent, except that the educational and tech-
nical supplies of the County Board of Education may continue
to be purchased as the County Board of Education may deter-
mine. And the Board of County Commissioners may authorize
by formal resolution any bi-county commission or other agency
of government, including the County Board of Education, the
Purchasing Department of which Commission or agency of
Government is approved in such formal resolution by the Board
of County Commissioners, to make directly and on their own
account, any and all purchases even though such purchases will
be paid for in whole or in part with money raised through the
annual tax levy of the Board of County Commissioners. The
Purchasing Agent is authorised by this Act to purchase for the
Maryland National Capital Park and Planning Commission
and Liquor Control Board upon such terms and conditions as
may be approved by that Commission or Liquor Control Board
and the Board of County Commissioners. It shall be the duty
of the Purchasing Agent to prescribe rules and regulations
under which estimates of the needs of using authorities shall be
submitted, and requisition made, and under which contracts
for purchases may be made.
