upon the application or upon any postponement of such time,
any person shall be heard on either side of the question, and in
Baltimore City if it shall appear that more than fifty percent
(50%) in number of the owners of real or leasehold property
situated within 200 feet of the place of business for which appli-
cation is made are opposed to the granting of the license, or if
the Board of License Commissioners for said City or any
County determines that the granting of the license is not
necessary for the accommodation of the public or that the ap-
plicant is not a fit person to receive the license applied for, or
has made a material false statement in his application, or has
practiced fraud in connection with said application, or that
the operation of the business, if the license is granted, will un-
duly disturb the peace of the residents of the neighborhood in
which the place of business is to be located, or that there are
other reasons, in the discretion of the Board, why the license
should not be issued, then the application shall be disapproved
and the license applied for shall be refused. If no such findings
are made by the Board, then the application shall be approved
and the said Board shall issue its certificate of approval for
presentation to the Clerk of the Court of the County in which
the place of business is to be located, and the said Clerk shall
issue the license applied for upon presentation of said certifi-
cate, and the payment of the fee required.
SEC. 2. And be U further enacted, That this Act shall take
effect June 1, 1945.

CHAPTER 862.
(House Bill 865)
AN ACT to add a new section to Article 41 of the Annotated
Code of Maryland (1939 Edition), title "Governor—Execu-
tive and Administrative Departments", sub-title "Maryland
Flag", said new section to be known as Section 60A to fol-
low immediately after Section 60 of said Article, relating
to the ornament affixed to the top of a flag staff carrying
the flag of Maryland.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
41 of the Annotated Code of Maryland (1939 Edition), title
"Governor—Executive and Administrative Departments", 'sub-
title "Maryland Flag", said new section to be known as Section
