such charges and assessments are benefit charges and shall not
be subject to any limitation.
The Commissioners may by appropriate order, upon applica-
tion, provide for the payment of any assessment in annual
installments not exceeding five in number, on such terms and
conditions as may be deemed appropriate by said Commis-
sioners; provided, however, that no installment payment shall
be permitted unless an agreement with respect thereto has
been made by the property owner with the County Commis-
sioners prior to the performance of the work.
SEC. 7. And be it further enacted, That Sections 573, 575,
576, 5", 579, 580 as repealed and re-enacted by Chapter 349
of the Acts of 1939; 581, 589 as repealed and re-enacted by
Chapter 502 of the Acts of 1943; 597, 599, 600, 603, 604, 605,
606, 608, 610, 615, 616, 617, 618, 619, 620, 621, 622, 623, 624,
625, 626, 627, 628, 629, 630, 631, 633, 634, 635, 636, 638, 639,
640, 641, 642, 643, 644 and 645, as the same were repealed and
re-enacted by Chapter 499 of the Acts of 1943; 646, 647, 648,
649, 650, 651, 652, 665, 667, 671, 672, 673, 674, 6", 678, 679
as the same was enacted by Chapter 597 of the Acts of 1941;
684, 685, 686, 687, 688 and 689 of Article 3 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Balti-
more County", sub-title "Roads and Streets" be and the same
are hereby repealed.
SEC. 8. And be it further enacted, That all laws and parts
of laws inconsistent with the provisions of this Act be and the
same are hereby repealed to the extent of such inconsistency.
SEC. 9. And be it further enacted, That if any provision,
clause, sentence, word, phrase or part of this Act, or the ap-
plication thereof to any person, firm or corporation, or to any
given factual situation, is held invalid, neither the remainder
of this Act nor the application of such invalidated portion or
portions of this Act to other persons, firms or corporations,
and to other circumstances shall be affected thereby. If any
provisions, clause, sentence, word, phrase, or part of this Act
shall be declared to be in violation of any provision of the State
or Federal Constitutions, the remainder of said Act shall
stand and be effective notwithstanding. To the extent, and
only to the extent, of a judicial declaration of unconstitution-
ality or invalidity as to a given person, firm, or corporation, or
as to a given factual situation, the provisions of the law prior
to the passage of this Act shall remain in full force and effect
solely for the enforcement of rights as to such person, firm, or
corporation, or as to such factual situations.
