SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety and having
been passed upon by yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 812.
(House Bill 529)

AN ACT to add a new section to Article 3 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Balti-
more County", sub-title "Health and Sanitation" (Metro-
politan District), said new section to be known as Section
335A and to follow immediately after Section 335 of said
Article, providing for benefit assessments or charges against
property owners receiving sewer or water benefits, but whose
property is not susceptible of assessment under existing
provisions of the Metropolitan District Act.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and the same is hereby added to
Article 3 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Baltimore County", sub-title "Health
and Sanitation" (Metropolitan District), said new section to
be known as Section 335A, to follow immediately after Section
335 of said Article and to read as follows:

335A. Land not assessed and not liable to be assessed for
the construction and establishment of any sewer or water
system which is subject to use by said property, shall be
assessed by the Commissioners for the payment of such amount
as they shall determine to be reasonable and just for such
privilege and connection. Said assessment may be prorated
on an annual basis as is provided for other assessments in
Section 335 of this Act. Before the making of any assessment
or charge under the provisions of this section, the Commis-
sioners shall give notice to the owners of the property involved
of their intention to make such an assessment or charge and
an opportunity to be heard as to the reasonableness and
propriety of same.
