an oath; that they will diligently and faithfully,
to the best of their judgment discharge the duties
of their office, without favor partiality or prejudice;
and shall file the certificate of the officer before
whom the same was taken thereof, amongst the
records of the corporation.

CHAP. 373.

SEC. 12. And be it enacted, That the clerk and
chief bailiff shall give a bond payable to the com-
missioners in such penalty and with such security,
as the commissioners may require, conditioned for
the faithful performance of the duties of the office
of bailiff or clerk.

SEC. 13. And be it enacted, That the commis-
sioners shall receive all election returns, and de-
termine all questions arising thereon, and any per-
son conceiving himself aggrieved by reason of any
such decision may appeal to the Circuit court,
which shall have and determine the same and de-
termine who shall pay the costs of appeal.

SEC. 14. And fie it enacted, That the commis-
sioners may pass such ordinances not contrary to
law, as they may deem beneficial to the town, may
open and close streets, lanes and alleys, grade and
pave the same, remove nuisances and obstructions
therefrom, restrain all disorders and disturbances,
prevent all congregations of negroes in public
places, apprehend and fine all vagabonds, impose
a tax on dogs, geese and hogs running at large
in the streets, and may impose fines, penalties and
forfeitures for the violation of their ordinances,
and commit the offender to the county jail until
the same be satisfied with costs.

SEC. 15. And fie it enacted, That the commis-
sioners may as often as deemed advisable, cause
any assessment to be made of all real and personal
property within the corporate limits by a person to
be appointed and paid by them, and which assess-
ment shall not exceed the assessment of the same
property for county purposes, and the commission-
ers may levy a tax thereon, not exceeding in any
one year, twenty cents in the hundred dollars worth
of assessable property.

SEC. 16. And it be enacted, That any person
may appeal from the valuation made by the asses-
sor to the commissioners, who shall meet on the
first Monday in June, in each year after any such
