CHAP. 342.

if deemed by them necessary and expedient, any
deed or deeds of mortgages or trust as security for the
fulfilment of said company, of any of its contracts
or other liabilities.

Construction
of railroad—
rights rested
&c.

SEC. 8. And be it enacted, That the said com-
pany be and the same is hereby invested, with all
and singular the rights, powers and authority,
which are necessary to enable it to locate, construct
and maintain a railroad, not exceeding sixty-six feet
wide, as may be determined by the directors of said
company, by locating and constructing the same
on the surface of the ground, in whole or in part
of the line of said road, or by excavating, tunnel-
ing or parsing through or under the surface of land
or ground, as the directors may deem expedient or
necessary for the convenient transaction of its busi-
ness, and carrying away its coal, iron, ore and
other minerals and products of its property, begin-
ning at any point on, in or near the coal lands or
mines of said company, lying on or near George's
creek in said Allegany county, and running from
thence to the line of the State of Maryland, at or
near Piedmont, on the bank of the Potomac river
in the State of Virginia, so as to connect with the
Baltimore and Ohio Railroad; and also to locate,
construct and maintain such other railroad or rail-
roads, train or train road or roads, not exceeding
sixty-six feet wide, as may be determined by the
directors of said company, by locating and con-
structing the same on the surface of land, or by
excavating, tunneling or passing through or under
the surface of the ground, in whole or in part of
the line of any of said roads, as the directors may
deem expedient or necessary for the transaction of
its business, and carrying away its coal, iron, ore
and other minerals and products of its property,
being any point in or under, or near the coal or
coal lands or mines of said company, lying on or
near George's creek in said Allegany county, and
running from thence to such point or points in
Allegany county, as will enable said company to
connect the same with any other railroad or train-
road now constructed, or which may hereafter be
constructed, and may at any point on its own land,
or upon any other lands, which it may acquire by
gift, purchase or condemnation, connect such rail-
roads or train-roads, with any other railroad or
train-road now constructed thereon, and in lieu of
