1860.

ty taxes for the years of eighteen hundred and forty-
six, forty-seven and forty-eight, for the fourth elec-
tion district of Montgomery county, be and he is
hereby authorised and empowered to collect all fees
or balances of fees and taxes due and uncollected
by the said William 0. Chappell, in the county
and district aforesaid, in the same manner and
with the same power and privileges as are allow-
ed by existing laws, in such cases made and pro-
vided.

CHAP. 19.

SEC. 2. And be it enacted, That the said Wil-
liam Thompson, of R., shall in every instance be-
fore he shall proceed to the aforesaid collection,
make affidavit before some justice of the peace for
Montgomery county, that the same remains un-
paid to the best of his knowledge and belief, and
that he has not received any security or satisfac-
tion for the same, or any part thereof, more than

the credit thereon; Provided, that said affidavit,
shall not be held to be conclusive evidence of in-
debtedness to said William Thompson, of R., as
trustee to William 0. Chappell, but merely prima
facia evidence of such indebtedness.

Proviso.

SEC. 3. And be it enacted, That this act shall
not continue in force longer than two years from
the date of its passage.
