LAWS OF MARYLAND.

CHAP. 304.

from Ringold to the Pennsylvania line, if and when
extended thereto, and shall make a plat or plats of
said road, and file the same in the office of the
clerk of the Circuit court for Washington county
to be recorded, and the said commissioners, before
they act as such, shall each take an oath to locate
said road according to the best of his skill and
judgment, and that he is not interested in any land
through which said road shall pass.

SEC. 10. And be it enacted, That the said road
shall be opened according to the location made by
the said commissioners, if approved by the directors
of said company, and the said road shall be laid
out thirty-three feet wide, seventeen of which shall
be an artificial road, made of stone broken the
usual size, and the said commissioners may locate
said road from the bed of the road leading from
Leitersburg to Ringold, and if extended on the
bed of either of the roads leading from Ringold
to the Pennsylvania line.

Power to con-
tract and hold
property.

SEC. 11. And be it enacted, That the said presi-
dent and directors shall have full power to make
all the contracts, and require all the property ne-
cessary for making said road, erecting toll gates
and toll houses, and may appoint a treasurer and
any other agents, which may be necessary for the
purposes of said company.

SEC. 12. And be it enacted, That the president
and directors are hereby authorised to erect as many
gates on said road as may be necessary, and charge
tolls for traveling on said road, and fix the rate of
tolls; Provided, that the rate of toll for traveling
thereon shall not be greater per mile than those
authorized by the act of eighteen hundred and

or received until the said road has been completed

burg to Ringold.

Land, &c., for

the company

SEC. 13. And be it enacted, That in case the said
company shall not be able to agree with the owner
or owners of any land, over or through whose lands
the said road may be made, or on which they may
desire to erect a toll house, it shall be lawful for
said company to cause any justice of the peace of
Washington county to issue his warrant to the
sheriff of said county, directing him to summons
