1860.

LAWS OF MARYLAND.

CHAP. 284.

general meeting duly assembled, executed and de-
livered a certain mortgage on the said road, and
its revenues, to secure the sum of five thousand
nine hundred and sixty-four dollars and fifty-three
cents, and interest borrowed for the purposes of
said road; and whereas, afterwards, to wit: on
the twenty-third day of November, in the year
eighteen hundred and fifty-eight, the Circuit court
for Cecil county, in chancery, passed a decree in
due form on said mortgage, providing that on de-
fault of the payment of the sum named in said de-
cree, the said road and all the appurtenances, to-
gether with all the rights, liberties, franchises and
revenues, and all other the property of said com-
pany, should be sold; and whereas, default has
been made in the payment of the said sum of
money, and the trustee appointed by said decree
has sold said road together with its appurtenances
and all the rights, liberties, franchises and reven-
ues and all other the property of said company to
Edward T. Richardson, Joseph Richardson, Wm.
McClelland, Nicholas Hiss, George Earle and
Frances Green, and the said sale has been finally
ratified and confirmed by the said Circuit court
for Cecil county, in chancery, but doubts are en-
tertained, whether the purchasers under said de-
cree could lawfully exercise the rights and franchi-
ses heretofore conferred upon, and exercised by said
company; and whereas, it is important for the in-
terests of many citizens of Cecil county, especially
of those living along, and near to said road, that
the said road should be kept in good condition
and repair, which can only be done by conferring
ample powers and authority upon the purchasers
aforesaid to exercise the said rights and franchises
to their full extent; Therefore,

Authorised
to convey pro-
perty.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the trustee, appointed in and
by the said decree, be and he is hereby authorised
and empowered to grant, convey and transfer all
the property of said company designated and men-
tioned in said decree, by a good and sufficient deed
or deeds to the said Edward T. Richardson, Joseph
Richardson, William McClelland, Nicholas Hiss,
George Earle and Frances Green, the purchasers of
said road, their heirs and assigns, or to such other
