CHAP. 267

power to adjourn from time to time and from place
to place, and the president or any three of the
directors may call special meetings of the board, at
such time and place as they may think necessary.

Opening and
enlarging
road — rights
of company
with respect
thereto.

SEC. 5. And be it enacted, That it shall and
may be lawful to and for the said president and
directors, and those who may be in their employ-
ment for that purpose, to enter upon all and every
of the lands and enclosures upon the route of the
present county road, between the places hereinbe-
fore named, to examine the ground most proper
for the purpose of opening and enlarging the said
road to the uniform width of forty feet, and also
upon the lands and enclosures adjacent to the same,
for the purpose of obtaining stone, gravel and other
materials, quarrying stone and removing material
for the purpose of constructing said road, its bridge,
culverts, and to survey, lay down, mark and locate
such track for the same, along the said road as
aforesaid, varying the same in widening to the
uniform width of forty feet, as in their best judg-
ment and skill will combine shortness of distance,

Proviso.

and the best and most practicable ground; Pro-
vided, That no buildings, garden or orchard, shall
be encroached upon, without the consent of the
owners or possessors thereof, but at the same time
investing the president and directors aforesaid, with
the legal authority to open and enlarge the present
county road, where the same is required under pre-
sent laws to be forty-feet wide, and that the per-
sons encroaching upon the old bed of the said
Hamburg road, shall be entitled to no damages in
the premises.

Road — how
constructed.

SEC. 6. And be it enacted, That the president
and directors shall cause the said road to be laid
out and opened to at least forty feet width, and
have ditches cut and opened on one side or the
other, or on both sides, where the same shall by
them be deemed to be necessary; with suitable
breaks upon and across the said road where the
same shall be necessary, and in every way construct
the said road, as that the water may be thrown off
from the said road into the ditches and culverts,
hereby authorised and required, or into grounds
adjacent to said road; that the said president and
directors shall open all drains, make and construct,
culverts, bridges over the creeks and water-courses
upon the said road, where the same is crossed by
