CHAP. 252.

Proviso.

sary for the construction of said bridges; Provided,
nevertheless, that the president and managers of
said company may agree with the owners for the
purchase of the same, and in case they shall not be
able to agree with said owners, or if said owners
should be feme coverts, non compos mentis, or
minors, the president shall then proceed in the
manner directed by the ninth section of this act,
and all appropriations of lands or materials
for the construction of said bridges shall be sub-
ject to the same restrictions specified in the ninth
section of this act.

Toll-gather-
ers.

SEC. 13. And be it enacted, That the said com-
pany, having perfected the said road aforesaid, and
the same being examined, approved and licensed,
in manner aforesaid, it shall be lawful for them to
appoint such and so many toll-gatherers as they
shall think proper, to collect and receive of or from
any person or persons using said road, the tolls
and rates per mile, the same to be regulated by the
president and managers of the company; Provided,
that the rates and tolls so regulated shall not ex-
ceed those of other roads of a like nature in this
State, and to stop any person riding, leading or
driving any horses, mules, oxen, coaches, cart,
wagon, wain or sled, cattle, hogs, sheep, sulky,
chaise, pheaton, or other carriage of pleasure or
burden, from passing through the said gates until
the tolls for the said passage shall have been paid;
Provided, that no toll gate shall be erected with-
in one mile of Libertytown, or of the Union School
House, at or near Mount Pleasant.

SEC. 14. And be it enacted, That the said com-
pany shall be, and they are hereby clothed and in-
vested, as respects the said road, with all and sin-
gular, the rights, privileges, immunities and ad-
vantages, not inconsistent with the provisions of
this act, that are held, used and possessed by the
turnpike companies of this State, and shall be sub-
ject to the same fines, penalties, and governed by
the same regulations as the said companies now
are, where the same are not inconsistent with the
provisions of this act.

SEC. 15. And be it enacted, That the president
and managers of said company shall keep a fair
and just account of all moneys received by them,
from the said commissioners, and from the said
subscribers, to the said undertaking, on account of
