1860.

receive one dollar per day during their attendance,,
which, said fees and allowances shall be paid by the
said, company; and the said company, or their
agents, shall have power to remove said material
aforesaid across any lands not in meadow, or grain,
upon paying reasonable compensation to the own-
er or owners, for any injury or damages, to be as-
certained by a jury as above, in case it cannot be
obtained by agreement.

CHAP. 252.

SEC. 10. And be it enacted, That the said com-
pany shall cause the said road to be laid out and
opened, which said road shall be as wide as the
bed of the old road upon which they propose to
build, and shall cause sixteen feet thereof, or any
greater portion or width they may determine, to be
made an artificial road of stone or gravel, upon the
plan, style, depth and level of the road leading
from the Monocacy bridge to Frederick city, which
they intend this road to connect with, as far as is
consistent with the nature of the ground, and shall
during the continuation of this corporation, main-
tain and keep the said road in good and perfect or-
der and repair, during the continuation of the cor-
poration.

SEC. 11. And be it enacted, That as soon as the
president and managers have, for the said com-
pany, perfected the said road, they shall give no-
tice to the Governor of the State, who shall there-
upon forthwith nominate and appoint three skil-
ful and judicious persons to review and examine the
same, and report to him, in writing, whether the
said road is so far executed in a masterly and work-
manlike manner, according to the true intent and

them, shall so report affirmatively, then the Gov-
ernor shall, by license under his hand and the seal
of the State, permit the president, managers and
company aforesaid to erect such and so many gates
upon and across the said road, as will be necessary
and sufficient to collect the tolls and duties herein-
after granted to said company, from all persons
traveling on the same with horses, cattle, wagons,
carts and carriages.

SEC. 12. And be it enacted, That the said com-
pany shall have power to erect bridges over all
streams of water crossing the said road, and may
enter upon and take all land and materials neces-
