1860.

Provided, said rates of toll shall not exceed that
now charged on the National road, but the said
rate of tolls may be at any time altered and regu-
lated by the Legislature of this State.

CHAP. 138.

Proviso.

SEC. 8. And be it enacted, That as soon as the
president and directors of said company shall be
elected, they shall have power to collect and re-
ceive the subscriptions so made to said capital
stock, and in case any subscriber thereto shall
fail or neglect to pay the amount by him or it sub-
scribed, the said company may maintain an action
therefor and recover the amount thereof with in-
terest from the time when such failure or neglect

ploy all such officers, agents or servants, as may
be deemed necessary either in making said road or
in the repair and management thereof after the

take effect from and after the date of its passage.

CHAPTER 138.

In force.

AN ACT to incorporate the Baltimore and Tow-
sontown Railroad Company.

16, 1860.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Elisha F. Lupton, Jervis Spencer,
William B. Lupton, G. J. Gordon and Charles G.
Ridgely, be and they are hereby appointed com-
missioners to open books and receive subscription
to the capital stock of the Baltimore and Towson-
town Railroad company hereby incorporated, and
they or a majority of them shall, at any time
within two years after the passage of this act, pro-
cure a sufficient number of suitable books, which
