sessment, who shall make oath before the said com-
missioners that they will faithfully and impartially
make the same to the best of their judgment, and
they shall be paid for their services by said com-
missioners out of the taxes levied as aforesaid.

CHAP. 128.

SEC. 3. Any person who may deem, himself ag-
grieved by said assessment may appeal for relief to
the said commissioners within thirty days after the
return made by the assessors.

SEC. 4. The said commissioners shall have the
power annually to make abatements and transfers,
and to cause a new assessment to be made accord-
ing to the provisions of the preceding sections,
whenever they shall deem it necessary.

SEC. 5. The said commissioners shall have power
to purchase or condemn for the use of said town
any land within a half of a mile of the limits of
the same, not exceeding two acres, and shall pay
the owner therefor such sum as may be agreed upon
between them, and in case they cannot agree, they

shall each appoint an arbitrator, with the power
to them to call in a third; and in case the owner
shall refuse or neglect to appoint an arbitrator
after twenty days notice, the said commissioners
shall appoint two persons with power to call, in a
third in case they disagree, and their award and
valuation shall be final and conclusive, the said
valuation to be paid within twelve months from
the time of the award; the taxes levied as afore-
said shall be collected as State and county taxes-
are now collected, and the bailiff of said town shall
have all the power of county collectors in enforcing
the payment of the same.
