CHAP. 113

shall constitute, appoint and employ such officers,
agents and servants for 'the construction, repair
and preservation of said road and for the receipt
and collection of tolls and transacting all other
business of said company as in their judgment may

be necessary.

Construction.

SEC. 9. And fie it enacted, That nothing in this
act contained shall be so construed as to authorise
said company or its agents or officers to issue any
scrip or bank note or. exercise any banking privi-
lege.

In force.

SEC. 10. And be it enacted, That this act shall
take effect from the date of its passage.

CHAPTER 113.

AN ACT to incorporate the Carrollton Avenue

Company.

Incorporated

SECTION 1. Be it enacted by the General Assembly
of Maryland, That a company be and is hereby in-
corporated to make a Turnpike road from the pre-
sent limits of Baltimore city, at or near the wes-
tern termination of McDonough street as laid out
on the plat of said city, to a point on the Patapsco
Falls southeast of the mill known as Worthing-
ton mill, with a lateral branch road from the said
Turnpike road, to a point on the Baltimore and
Ohio Railroad at or near the Relay House Station
on the said Railroad.

ers to open
books, &c.

SEC. 2. And be it enacted, That for the mak-
ing of said road, subscription books shall be open-
ed in the city of Baltimore under the direction of
Michael K. Wartman, John C. Wartman, George
A. Remicker, George Richstein and John Glenn,
for the capital stock of thirty thousand dollars, in
shares of twenty dollars each, and the persons
above named are hereby appointed commissioners,
who shall for this purpose, on or before the first
Monday in June next, after at least two weeks
notice in one or more newspapers published in Bal-
timore city, of the time and place of opening of
such subscription books, meet at the time and
place appointed at which meeting at least three of
