THORIZED USE OR OCCUPANCY OF A MOTOR VE-
HICLE OR OPERATING A MOTOR VEHICLE WHILE
UNDER THE INFLUENCE OF INTOXICATING LIQ-
UORS OR DRUGS.

If the Judge retains jurisdiction in such a case, the
hearing on the charge shall be before the Judge without
a jury, unless the parent or guardian of such child shall
elect to have the case tried before a jury.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1950.

CHAPTER 38
(Senate Bill 101)

AN ACT to repeal and re-enact, with amendments, Sec-
tion 5 of Article 38 of the Annotated Code of .Maryland
(1947 Supplement), title "Fines and Forfeitures," re-
lating to the disposal of certain excess fines allocated
for the augmentation of court libraries.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 5 of Article 38 of the Annotated Code of
Maryland (1947 Supplement), title "Fines and Forfei-
tures/' be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

5. One-half of the fines imposed and recognizances
forfeited to the Circuit Court for the several counties of
the State, shall be paid to the clerks of the respective
courts, to be expended under the direction of the judge
or judges of said courts, for the augmentation of the
libraries of said courts, provided any amount in excess
of $5,000 in any year in any county shall be paid to the
county commissioners of such county for genral purposes,
and one-half of the fines and recognizances received by
the City Treasurer of Baltimore City from the justices
of the peace in Baltimore City and the Sheriff of Balti-
more City, as adjudged by and accruing in the Criminal
