35. Inspectors of factories, supervisors of pupil personnel
and other authorized inspectors may visit and inspect at any
time any place of employment mentioned in this sub-title and
shall ascertain whether any minors are employed therein
contrary to the provisions of this sub-title. It shall be the
duty of factory inspectors, supervisors of pupil personnel and
other officers charged with the enforcement of this sub-title,
to make complaints against any person violating any of the
provisions of this sub-title and to prosecute the same. This
section shall not be construed as a limitation upon the right
of other persons to make and prosecute such complaints.

36. A failure by an employer to produce to a factory in-
spector or other authorized inspector or officer charged with
the enforcement of this sub-title, any employment certificate
or list required by this sub-title shall be prima facie evi-
dence of the illegal employment of any child whose employ-
ment certificate is not produced or whose> name is not so
listed.

37. Nothing in this sub-title shall prevent minors of any
age from receiving industrial education furnished by the
United States, by this State, or by any city or town in this
State, or by any private or parochial school, and duly ap-
proved by the State Board of Education or by other duly
constituted public authority.

38. The Commissioner shall have the discretion of issuing
a special employment certificate to minors over 14 years of
age, who are mentally retarded and are declared to be in-
capable of profiting by further educational instruction and
are unable to make further advancement at school, upon the
written recommendation of the Superintendent of Education
of the City of Baltimore or any county in the State, as the
case may be, and said Commissioner may exercise vocational
supervision over such children until they reach the age of
18 years.

39. The Commissioner shall have the discretion of issuing
a co-ordination employment certificate to a minor over 14
years of age who is participating in a school-work co-ordina-
tion plan under the direction and supervision of the Depart-
ment of Education, City, County or State.

40. No fee shall be charged or collected from any minor,
or from his parents, guardian, legal custodian or next friend
for any services rendered by the Department of Labor and
