balances of monies as of June 30, 1947, heretofore derived
from gasoline taxes prescribed by prior laws and held by the
State Roads Commission or by the State Treasurer or State
Comptroller for the account of the State Roads Commission,
(2) all unexpended balances heretofore derived from license
fees, registration fees and other revenues collected by the
Department of Motor Vehicles pursuant to Article 66 1/2 of
the Annotated Code of Maryland (1947 Supplement), pur-
suant to Sections 293 to 310, both inclusive, of Article 56 of
said Code (1939 Edition and 1947 Supplement), title "Li-
censes", sub-title "Public Passenger Motor Vehicles'", pursuant
to Sections 311 to 323, both inclusive, of Article 56 of said Code
(1939 Edition and 1947 Supplement), title "Licenses", sub-title
"Public Freight Motor Vehicles", and pursuant to Sections
218 and 219 of Article 81 of said Code (1939 Edition
and 1947 Supplement), title "Revenue and Taxes"', sub-
title "Mileage Tax for Use and Maintenance of Roads", and
held by the State Roads Commission or by the State Treasurer
or State Comptroller for the account of the State Roads
Commission or held by the Department of Motor Vehicles to
be remitted to the State Treasurer or State Comptroller for
the account of the State Roads Commission; provided, how-
ever, that all monies so added to said Fund pursuant to this
section shall remain subject to disbursement to the extent
required by any lawful pledge, dedication or commitment
thereof now existing, or to the extent necessary to discharge
any now existing lawful obligation of, or valid claim against,
the Commission whether or not such obligation or claim is
now contingent or unliquidated in amount.

SEC. 2. And be It further enacted, That a new paragraph
be added to Section 11 of Article 89B of the Annotated Code
of Maryland (1947 Supplement) title "State Roads", sub-title
"Distribution and Use of Special Funds", to be known as
Paragraph (f) of said section and to follow immediately after
Paragraph (e) of said section, and to read as follows:

11.

(f) In case of an emergency whereby the Motor Vehicles
Revenue Fund created by Section 285 of Article 66 1/2 of the
Annotated Code of Maryland (1947 Supplement) is insuffi-
cient to maintain properly the State Highway System, the
State Roads Commission, with the consent of the Governor
and under the provisions of Section 8 of Article 15A of the
Annotated Code of Maryland (1947 Supplement), may in any
fiscal year, transfer from the Construction Fund described
in Section 11 of this Article, to the Motor Vehicle Revenue
Fund, a sum not to exceed Two Million Dollars ($2,000,000.00),
in such fiscal year, such funds, when so transferred, to be
used for the maintenance and operation of the State Highway
System.
