town and five persons to be City Councilmen of said town.
Those two persons who receive the highest and the next
highest number of votes in said election for City Councilmen,
being otherwise qualified for said office under this section,
shall hold office for the term of four years from the second
Monday in September next after the election and until their
successors are elected and qualified; those other three persons
who shall be elected City Councilmen at said election shall
hold office for the term of two years, from the second Monday
in September next after the election and until their successors
are elected and qualified. The Mayor elected on the second
Monday in August, 1948, shall hold office for the term of two
years from the second Monday in September next after the
election and until his successor is elected and qualified. On
the second Monday in August, 1950, and on the second Mon-
day in August in each second year thereafter the said qualified
voters shall elect by ballot one person as Mayor of Ocean
City to serve a term of two years from the second Monday
in September next after the election and a sufficient number
of City Councilmen to succeed those whose terms are about
to expire, those City Councilmen so elected in the year 1950
and thereafter to serve for a term of four years from the
second Monday in September next after their election and
until their successors are elected and qualified. Any person
to qualify for election as Mayor or City Councilman of Ocean
City must be the owner of real estate in said town of the
assessed value on the town tax books of at least one thousand
dollars and at least three of said City Councilmen must be
bona fide residents of said town, and no person shall be
eligible for election either as Mayor or City Councilman
unless he shall file, not less than ten days before said election^
with the then Secretary of the Mayor and City Council, a
certificate in writing containing the name and address of the
person seeking office and the office to which he seeks to be
elected, such certificates to be duly acknowledged by the
person filing the same before an officer authorized to take
acknowledgments under the laws of the State of Maryland who
shall append to such certificate of candidacy a certificate of
such acknowledgment. No votes cast for any person who
has not filed his certificate of candidacy as aforesaid shall be
counted by the judges of election. If any person so elected
as Mayor and City Councilman shall refuse to serve or if his
place shall become vacant by death, resignation, disqualifica-
tion or otherwise, the remaining Councilmen or Councilman
if there is only one, shall fill the vacancy or vacancies as
early as possible from among the qualified voters of said
town eligible to serve as Mayor or Councilman, and the
person so appointed shall hold his office until the next elec-
tion; and in case of a tie between any persons voted for at
