SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 194 of the Montgomery County Code (1947
Edition, being Article 16 of the Code of Public Local Laws
of Maryland), title "Montgomery County", sub-title "County
Commissioners and Treasurer", be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
194. The Board of County Commissioners shall appoint a
clerk, to serve at the pleasure of the Board of County Com-
missioners, and for his services he shall receive a salary to
be determined by said Board not to exceed the sum of three
thousand ($3,000.00) dollars per annum. Before entering
upon the duties of his office he shall execute a bond to the
State of Maryland in form and with surety to be appproved
by said Board, in the penalty of ten thousand ($10,000.00)
dollars, conditioned upon the true and faithful performance
of the duties of his office, said bond to be recorded in the
office of the Clerk of the Circuit Court for Montgomery
County. He shall give his personal attendance to and keep
open the office of the County Commissioners during business
hours on every week day except legal holidays. He shall
have charge of all records, files, books and papers belonging
to the office of said Board and shall not allow any of them
to be removed or taken from said office except in obedience
to a subpoena duces tecum or other order issued by a court
of competent jurisdiction, and shall deliver all such records,
files, books and papers to his successor in office and shall
perform such other duties authorized or directed by said
Board not inconsistent with law. The said Board may, in its
discretion appoint two assistant clerks, each at a compensa-
tion as set by the said Board of County Commissioners, one
additional assistant clerk at a compensation as set by the
said Board of County Commissioners and such other addi-
tional clerks or stenographers at such compensation not
to exceed one thousand five hundred ($1,500.00) dollars per
annum, as said Board may determine. Any assistant clerk
appointed shall be required to give bond under the same
conditions as are above described for the bond of the clerk,
in the penalty of one thousand ($1,000.00) dollars.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1948.
