to whom he may apply for the same the following rates,
namely: for a sneak boat, Five Dollars ($5. 00), for each and
every gunning season as defined herein, and in addition to the
moneys received from licenses aforesaid the Clerk of the Court
shall collect and retain in lieu of all other compensation the
sum of Fifty Cents (50^) for issuing each license. Said license
shall not be transferable and if used on any sneak boat other
than the one for which it was issued said license shall be con-
fiscated and the person to whom it was issued prosecuted for
violation of this sub-title. Said license shall only be valid
during the legal open season for hunting wild water fowl, and
it shall be the duty of every person obtaining a license to ex-
hibit the same whenever called upon by any officer of this
State or any other person who shall demand to see the same.

Each and every applicant for such license shall make oath
before the Clerk of the Court authorized to issue the same that
he is a bona fide resident of this State and that he will not
employ on a gunning rig any person except a bona fide resident
of this State and that he will comply with all the provisions of
the law regulating the hunting of wild water fowl in the terri-
tory designated as the Flats, and every person to whom such
license may be granted shall be required to paint the name or
number of the sneak boat on some prominent part thereof in
large legible letters or numbers, as the case may be, to cor-
respond with said name or number of license issued to him.

62. PENALTY. Any person convicted before any Justice of
the Peace of this State for violating any of the provisions of
Sections 53 to 61, inclusive, unless otherwise provided, shall
be fined not less than Twenty-five Dollars ($25. 00) nor more
than Fifty Dollars ($50. 00) and costs for each and every
offense, and in addition shall pay a penalty of Five Dollars
($5. 00) for each bird found in possession killed illegally, and
shall stand committed to jail until such fine and costs have
been paid, and in addition to said fine and costs the Justice of
the Peace shall order the officer making the arrest and secur-
ing the conviction to seize and hold in custody all vessels,
crafts, sneak boats, decoys, and all other paraphernalia used
in violation of the provisions of this sub-title and shall exclude
the gunning rig from the Flats for three legal gunning days
which shall include such gunning days as said gunning rig
may have been excluded prior to the determination of the case.
Provided, however, in case of appeal the rig shall be released
but in case the Court before whom said appeal is heard sus-
tains the decision of the Justice of the Peace, then said person
or persons shall be fined double the amount so imposed by said
Justice of the Peace.
