the part of the defendant; at the time of said payment, how-
ever, they shall give their corporate undertaking to abide by
and fulfill any judgment on such appeal or further proceed-
ing. The provisions of this Section shall not apply to the
properties, plants, franchises and rights of the Mayor and
City Council of Baltimore, or to any property, plants, fran-
chises and rights that may be hereafter acquired by the
Mayor and City Council of Baltimore for the protection or
enlargement of its water supply, sewerage storm water drain-
age, or refuse disposal systems or any other of its utility
properties, except by and with the consent of the Mayor and
City Council of said city, but shall apply to any and all other
property necessary for the purposes of this Act which may,
at the time of condemnation, be subject to a prior public use
for water supply, sewerage and drainage systems.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1943.

AN ACT to repeal Section 307 of Article 3 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Bal-
timore County", sub-title "Health and Sanitation", and to
enact in lieu thereof a new section to be known as Section
307, said new section to follow immediately after Section
306. and providing for the preparation and placing of gar-
bage, trash, and offal for collection by agents of Baltimore
County, providing penalties for violations, and authorizing
the County Commissioners of Baltimore County to discon-
tinue trash and garbage collections where unduly burden-
some to the facilities of Baltimore County.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 307 of Article 3 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Baltimore County",
sub-title "Health and Sanitation", be and the same is hereby
repealed, and a new section is enacted in lieu thereof, said
new section to be known as Section 307, to follow immediately
after Section 306, and to read as follows:
307. All persons, firms or corporations in such places in
Baltimore County, as may be supplied with a force for the
