That Mrs. W. H. Dyer, Donald Maunder, and Howard Gagle
are hereby appointed to constitute the Board of Election
Supervisors for Ward IV, for the purpose of holding an elec-
tion as above stated and to carry out the purposes of this Act.

That if in such election a greater number of persons shall
vote "for incorporation" than shall vote "against incorpora^
tion", this Charter shall become immediately effective and
operative in that Ward which shall so vote. The failure of a
majority of any Ward to vote "for incorporation" shall not
affect any other Ward from becoming incorporated. Each
Ward shall stand upon the election returns of its own Ward
as to incorporation, the election of Councilmen from that
Ward and the votes for the Mayor from that Ward shall not
be counted from such Ward or Wards where a greater number
of persons shall vote against incorporation.

78. The term of all officers of said Town that are elected on
June 15, 1943, shall expire when the new officers are elected
and qualify in May, 1944.

And that thereafter the term of the office of Mayor shall be
for a period of two (2) years, and that the term of all Council-
men shall be for a period of two (2) years, provided, however,
that the Councilman who shall receive the greater number of
votes in each Ward in the May election of 1944, shall hold office
for a period of two (2) years and that the Councilman who
shall receive the next greater number of votes in each Ward
shall hold office for a period of one (1) year only.

79. If any part of this Act shall be held unconstitutional or
invalid, the same shall not affect the remaining part of this Act.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the date
of its passage.
