CHAPTER 74.
(House Bill 77)

AN ACT to repeal and re-enact, with amendments, Section 5
of Article 38 of the Annotated Code of Maryland (1939
Edition), title "Fines and Forfeitures7', relating to fines to
be paid to the Clerks of Court for the augmentation of Court
Libraries and providing that said clerks shall not be paid
any commission or charge for collecting and paying over
such fines, eliminating Caroline and Cecil Counties from the
list of counties exempt from the provisions of said sub-title
and restoring the amount to be paid the Library Company
of the Baltimore Bar, which had unintentionally been re-
duced through an oversight.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 5 of Article 38 of the Annotated Code of
Maryland (1939 Edition), title "Fines and Forfeitures", be
and the same is hereby repealed and re-enacted, with amend-
ments, to read, as follows:

5. One-half of the fines imposed and recognizances forfeited
to the Circuit Court for the several counties of the State, shall
be paid to the clerks of the respective courts, to be expended
under the direction of the judge or judges of said courts, for
the augmentation of the libraries of said courts, and one-half
of the fines and recognizances received by the City Register of
Baltimore City from the justices of the peace in Baltimore
City and the Sheriff of Baltimore City, as adjudged by and
accruing in the Criminal Courts of Baltimore City, and col-
lected and received by or through the said Sheriff, shall be
paid by said City Register to the Library Company of the
Baltimore Bar for its use and benefit. Said sum not to ex-
ceed, however, in any year the sum of seven thousand five hun-
dred dollars ($7, 500. 00). This section not to apply to Queen
Anne's, Anne Arundel and Talbot Counties. No commission
or charge shall be paid to any clerk of the court for collecting
and paying over said fines.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1943.
