Article 64A of the Annotated Code of Maryland (1939 Edition)
or under any other provisions of law or of Section 1 of this Act.

SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1943.

CHAPTER 555.
(House Bill 555)

AN ACT to add a new section to Article 52 of the Annotated
Code of Maryland (1939 Edition), title "Justices of the
Peace", sub-title "Trial Magistrates System", said new sec-
tion to be known as Section 94A, and to follow immediately
after Section 94 of said Article^ providing for the appoint-
ment of an additional Justice of the Peace in Cecil County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
52 of the Annotated Code of Maryland (1939 Edition), title
"Justices of the Peace", sub-title "Trial Magistrates System",
said new section to be known as Section 94A, to follow im-
mediately after Section 94 of said Article, and to read as
follows:

94A. In addition to the Justices of the Peace authorized to
be appointed under the provisions of Sections 94 and 100 of
this sub-title, the Governor shall appoint one Justice of the
Peace for Cecil County who shall act as a committing magis-
trate. He shall preside in the office of the Sheriff every night
from 9 P. M. to 6 A. M. He shall have, possess and exercise
all the civil and criminal jurisdiction conferred upon other
Justices of the Peace in Cecil County, except that he shall
have no jurisdiction to try cases. In addition, he shall have
power to take recognizance for the appearance of any accused
before the Trial Magistrate and to act as turnkey during the
hours during which he is on duty. He shall receive such com-
pensation as shall be prescribed by the County Commissioners
of Cecil County.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect May 1, 1943.
