men's Compensation, " sub-title "Application of Article;
Extra-hazardous Employment, " said new sub-section to be
known as Sub-section (41 A) and to follow immediately after
Sub-section (41) of said section, providing that certain em-
ployees in connection with the operation of vehicles shall be
entitled to the benefits of the workmen's compensation law,
whether the injury was sustained within this State or else-
where.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new sub-section be and it is hereby added to Sec-
tion 33 of Article 101 of the Annotated Code of Maryland
(1939 Edition), title "Workmen's Compensation, " sub-title
"Application of Article; Extra-hazardous Employment, " said
new sub-section to be known as Sub-section (41A), to follow
immediately after Sub-section (41) of said section, and to read
as follows:
33. (41 A) All truck drivers, helpers, mechanics, loaders and
other persons employed to perform their work in the State and
elsewhere, in or about the operation of trucks, wagons or other
vehicles, propelled by mechanical or other power, who are citi-
zens or residents of this State, employed by a person, firm or
corporation having a place of business within this State,
whether the injury or death for which compensation is asked
was sustained within this State or elsewhere, provided, how-
ever, that nothing contained in this sub-section shall apply to
farm laborers, and provided, further, that no persons shall
be entitled to recover compensation for injuries sustained or
death incurred under both the laws of this State and the laws
of the State in which such injuries or death occurred and
the filing of a claim under the laws in this State shall consti-
tute an election to recover compensation under the laws of
such State and no other.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1943.
