5. B (Beer and Light Wine Licenses, Class B. (On Sale) —
Hotels and Restaurants. ) Such a license shall be issued by
the Clerk of the Circuit Court of the County in which the
place of business is located, or by the Clerk of the Court of
Common Pleas of Baltimore City, if the place of business is
located in said City, and shall authorize the holder thereof
to keep for sale and sell beer and light wines at retail at any
hotel or restaurant, at the place therein described, for con-
sumption on the premises or elsewhere. The annual fee for
such a license shall be Sixty Dollars ($60. 00), except in Wi-
comico County where the fee shall be Fifty Dollars ($50. 00),
and shall be payable to said clerk, before any such license is
issued, for distribution as hereinafter provided.

This Section shall not apply to Allegany, Anne Arundel,
Calvert, Caroline, Dorchester, Frederick, Garrett, Harford,
Howard, Kent, Queen Anne's, St. Mary's, Somerset and Tal-
bot Counties.

The hours during which the privileges conferred by such a
license may be exercised shall be from 6 A. M. to 12 o'clock
midnight except in Baltimore City and Baltimore and Wash-
ington Counties where the hours shall be from 6 A. M. until
2 A. M. on the day following and except in Prince George's
County where the closing hours shall not apply, but the holder
of such license shall not be permitted to make any sale on the
day of any general, special or primary election.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect May 1, 1943.

AN ACT to repeal and re-enact, with amendments, Section 84
of Article 77 of the Annotated Code of Maryland (1939
Edition), title "Public Education", sub-title "Chapter 7.
Schools. ", providing that schools shall remain open in Wico-
mico County on election days.
