funds for general use in the County has been made on a care-
fully thought-out basis and if in-roads are made in the County
fund through payments to the various towns, the Commission
will be prevented from maintaining the roads as they should
be maintained.
In view of the aforegoing, I am vetoing this Bill.
Chapter 528 (House Bill 437). This measure seeks to amend
Section 9 of Article 89B in order to make possible the use of the
Lateral Road Gasoline Fund in Caroline County for debt
service payments.
The State Roads Commission urges that this Bill be vetoed,
setting forth the same reasons as were advanced in connec-
tion with the request to veto the St. Mary's County Bill, which
also sought to use the proceeds from this same fund for debt
service payments.
As pointed out in the previous memorandum, the portion of
the 1%-cent Gasoline Tax for maintenance purposes is not suffi-
cient to maintain properly the highways. If this money is
diverted to debt servicing requirements it would inevitably
result in a diminution of the amount required for the proper
maintenance of the roads.
Under the circumstances I will veto this Bill.
Chapter 414 (Senate Bill 345). This enactment undertakes
to add a new section to Article 89B of the Annotated Code
to authorize and direct the State Roads Commission to pay
certain sums of money to the incorporated towns of Wicomico
County from the One and One-half Cent Lateral County and
Municipal Road Fund allocated to this County.
The Bill was introduced by Senator R. Fulton Waller of
Wicomico County and was passed after favorable action had
been taken upon it by the majority of the Wicomico County
representatives in the House of Delegates.
However, since the enactment of this Bill, these representa-
tives, including Senator Weller, constituting a majority of the
Delegation, asked that the Bill be vetoed. The Senator and
Delegates point out that if signed, this enactment might seri-
ously affect the money available in Wicomico County for the
maintenance and up-keep of the lateral road system. It is
apparent that the intention was to amend the Bill in order to
provide that the allocations be made on a percentage or pro
rata basis but, through inadvertence, such amendments were
not adopted.
In requesting that I veto the measure, the Delegates empha-
size the fact that with food so essential for the successful prose-
cution of the war, it would be unfortunate if anything were
done to interfere with the proper maintenance of the roads
