number shall fall due and become payable at stated periods
to be determined by ordinance of the Mayor and Aldermen.
The State Law Department has ruled that these provisions
are not specifically sufficient to comply with Sections 35 and 36
of the Code and that as a result, the validity of any bonds
issued under this authority would be questionable.
Realizing the effect that this may have upon the marketabil-
ity of the bonds and because of the serious legal question in-
volved, I have decided to veto House Bill No. 344.
Chapter 716 (Senate Bill 197). This Bill seeks to vest the
Frederick County Road Board with extensive powers concern-
ing the regulation of weights of trucks, the regulation of speed
and prescribed penalties for violation of these regulations.
The Attorney-General points out in his opinion that the
broad powers granted by this Bill to a local Board for regula-
tion of motor traffic is unnecessary because of the fact that the
State-wide law contains full regulations relating to the width
and weight of motor vehicles. The opinion also points out that
the grant of such powers to local authorities would tend to cre-
ate confusion because different speed limits might be prescribed
in one area that are totally different from those in an adjoining
County.
In addition, the Frederick County Road Board, through its
Engineer, asks that this Bill be vetoed, basing the request on
the following reasons:
1. That the Bill was passed during the last hours of the
Legislative session and will handicap and retard the work-
ability of the County system with no benefits.
2. That the operation of the law will be detrimental to
Frederick County.
3. That from an engineering standpoint the methods pre-
scribed are unsound and impracticable.
Under all the circumstances, I feel compelled to veto this
measure. '
GASOLINE TAX FUND.
Chapter 731 (Senate Bill 443). This Bill authorizes and
requires the State Roads Commission to pay the Mayor and
Council of Crisfield and the President and Commissioners of
Princess Anne a certain sum of money from the Lateral Road
Gasoline Tax Fund.
The State Roads Commission opposes the approval of this
Bill and points out that if its terms were fulfilled there would
be a reduction in the amount of money available for the mainte-
nance of the public roads in Somerset County. In other words,
