District, and to submit to the Legislature from time to time
any other recommendations respecting legislation which the
Commission, as a result of its activities, may regard as to the
best interests of the District.

XII. Every act or omission designated as a misde-
meanor in this Act, unless otherwise provided, shall be punish-
able before the Circuit Court or the proper trial magistrate
or justice of the peace of the county in which such offense is
committed and shall be brought by warrant or indictment upon
the oath or information of any member of said Commission
or any employee thereof, and the offender shall, upon convic-
tion, be subject to a fine not exceeding one hundred (f 100. 00)
dollars or thirty days in the County Jail, or both, in the dis-
cretion of the Court. Where such an act or omission is of a
continuing nature or is persisted in, in violation of the pro-
visions of this Act or of any rule or regulation formulated
thereunder, a conviction for one offense shall not be a bar to a
conviction for a continuation of such offense subsequent to the
first or any succeeding conviction.

XIII. WHEREAS, a paper writing has been pre-
sented to the Supreme Court of the District of Columbia,
In Probate, as and for the last Will of Violet Blair Janin
who died in said District January 14, 1933, and probate of
the same as such petitioned for by the Executors named there-
in, namely, Woodbury Blair of Washington, D. O., Blair Lee
of Montgomery County, Maryland, and the National Savings
and Trust Company of Washington, D. C., and

WHEREAS, further said paper writing contains a provision
as follows:

ITEM XVII. I give and devise, in fee simple, the remain-
ing portion of my farm, "The Moorings, " near Silver Spring,
Montgomery County, State of Maryland, from the trees front-
ing on the Brookville Pike and the road on the south, together
with all improvements thereon, unto the State of Maryland,
for the establishment of a public park thereon, in memory of
my beloved brother, Jesup Blair, subject to the following con-
ditions:

That this devise be accepted by the General Assembly of
the State of Maryland within three years after the date of
my death.

That ample provision shall be made for the perpetual main-
tenance of said property as a park open to the public.

That all of the trees now upon the property be preserved
except such of them as it is absolutely necessary to remove in
connection with the laying out of such park. It is my earnest
