(e) All monies received by the Department pursuant to the
provisions of this Article, shall be accounted for and remitted
by the said Department to the State Treasurer, who shall
create a special fund thereof. Out of the special fund so cre-
ated, the State Treasurer shall first pay all refunds of motor
vehicle registrations in this Article provided and all monies
payable or deductible under any of the laws of this State and
within the limits of the appropriations made by the General
Assembly, all the salaries and expenses of the Department, the
Traffic Court of Baltimore City, and the Department of the
Maryland State Police. The balance of said fund shall be dis-
bursed, upon warrant to the Comptroller, as follows: Three
tenths (30%) thereof shall be paid to the Mayor and City
Council of Baltimore, for use on its streets and highways and
for no other purpose, and the remaining Seven tenths (70%)
shall be credited to the account of the State Roads Commission
of Maryland, to be used for the oiling, maintenance, recon-
struction and repair of State Roads and State-aided roads and
for no other purpose.

(f) Failure, refusal, or neglect on the part of any judicial
or other officer or employee receiving or having custody of such
fine or forfeiture to comply with the foregoing provisions of
this section shall constitute misconduct in the office and shall
be sufficient grounds for removal therefrom.

(g) Provisions of this Section which may be inconsistent
with the provisions of Article 52 "Trial Magistrate System"
shall be superseded by the provisions of the latter Article as to
such inconsistencies.

TRAFFIC COURT OF BALTIMORE CITY.

286. CREATION: There is hereby created a group of jus-
tices of the peace of the City of Baltimore at large to be known
by the collective term "Traffic Court of Baltimore City".

287. APPOINTMENT OF MAGISTRATES OF THE TRAFFIC COURT.
In addition to the justices of the peace provided for in Section
712 of Article 4 of the Code of Public Local Laws of Maryland
(1938 Edition), there shall be appointed by the Governor by
and with the advice and consent of the Senate from the City of
Baltimore at large, five or more justices of the peace to be
known as Magistrates of the Traffic Court who shall be of high
moral character and reputable members of the bar of the Su-
preme Bench of Baltimore City, who shall have been actively
engaged in the practice of the law for at least five years.

288. MAGISTRATE'S SALARIES. The Governor shall designate
one"of said Justices to be known as Chief Magistrate of the
