shall be filled by appointment by the President of the Senate
from among the members of the Senate, if the vacancy is
caused by the resignation or death of a member of the
Council from the Senate, and by the Speaker of the House
of Delegates, if the vacancy is caused by the resignation or
death of a member of the Council from the House of Dele-
gates, the appointments to be made in accordance with the
provisions of Sub-sections (1) and (2). If the vacancy
in the membership of the Council is caused by the resigna-
tion or death of the Chairman or Vice-Chairman, the va-
cancy in such membership shall be filled by the members
of the Council from the membership of the Senate or the
House of Delegates, as the case may be. In case of a va-
cancy in the office of Chairman, the Vice-Chairman shall be-
come Chairman and the members of the Council shall elect
one of its members Vice-Chairman in his stead; and in the
case of a vacancy in the office of both Chairman and Vice-
Chairman, the members of the Council shall elect one of its
members Chairman and one of its members Vice-Chairman.

SEC. 2. And be it further enacted, That this Act is here-
by declared to be an emergency law and necessary for the
immediate preservation of the public health and safety,
and having been passed by a yea and nay vote, supported
by three-fifths of all of the members elected to each of the
two Houses of the General Assembly, the same shall take
effect from the date of its passage.

(Senate Bill 607)

AN ACT to repeal and re-enact, with amendments. Sub-
section (Dorchester County) of Section 100 of Article 52
of the Annotated Code of Maryland (1939 Edition), title
"Justices of the Peace, " sub-title "Trial Magistrates Sys-
tem, " as said sub-section was amended by Chapter 224
of the Acts of 1941, relating to the salary of the clerk
of the Trial Magistrate sitting at Cambridge, Dorchester
County.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sub-section (Dorchester County) of Section 100 of
Article 52 of the Annotated Code of Maryland (1939 Edi-
tion), title "Justices of the Peace, " sub-title "Trial Magis-
trates System, " as said sub-section was amended by Chap-
