for special guard duty, and providing for their pay while so
engaged.
SECTION 1. Be it enacted l)y the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
65 of the Annotated Code of Maryland (1939 Edition), title
"Militia", sub-title "Maryland State Guard", said new section
to be known as Section 58CC, and to follow immediately after
Section 58C, as added to said Article by Chapter 33 of the
Acts of 1941, said new section to read as follows:
58CC. The Governor, when requested by the military or
naval authorities of the United States, or when he deems such
action necessary, is hereby authorized to order out and assign
the Maryland State Guard, any part thereof, or any individual
member or members thereof, for special duty in the guarding
and protection of strategic and essential facilities, utilities,
roads, bridges and other strategic or essential points, sites or
installations in the State. The officers and men of the Mary-
land State Guard, while serving on such special guard duty,
may receive, instead of the pay specified in Section 32 of this
Article, the following aggregate sums as pay and in lieu of
allowances and maintenance: Captains f 10. 00, First Lieu-
tenants $9. 00, Second Lieutenants $8. 00 per day; Sergeants—
$6. 00 per day; Corporals—$5. 50 per day; Privates—$5. 00
per day.
While serving on such special guard duty, commissioned
officers, non-commissioned officers and men shall be subject to
the same military rules and discipline that apply when they
are on other active duty, and they may be uniformed and
armed as when on other active duty.
From February 1, 1943, until the beginning of the next
fiscal year, all officers and men of the Maryland State Guard
detailed to special guard duty shall be paid from the same
funds and in the same manner as those now performing such
guard duty have heretofore been paid. After the beginning
of the next fiscal year, they shall be paid from the funds and
in the manner provided from time to time in the budget.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and
having been passed by a yea and nay vote, supported by three-
fifths of all the members elected to each of the two Houses of
the General Assembly, the same shall take effect from the date
of its passage.
