to repeal and re-enact with amendments Section 313
of Article 56 of the Annotated Code of Maryland (1939
Edition), title "Licenses", sub-title "Public Freight Mo-
tor Vehicles", to make correction of certain dates; and
to add a new section to Article 81 of the Annotated Code
of Maryland (1939 Edition), title "Revenue and Taxes",
sub-title "Mileage Tax for Use and Maintenance of
Roads", to follow immediately after Section 218 of said
Article, and to be known as Section 218A, and to pro-
vide for partial refunds of registration fees, under cer-
tain conditions, to owners of public passenger motor ve-
hicles used in interstate transportation.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 302 of Article 56 of the Annotated
Code of Maryland (1939 Edition), title "Licenses", sub-
title "Public Passenger Motor Vehicles", be, and the same
is hereby, repealed and re-enacted with amendments, to
read as follows:

302. Except as hereinafter provided, each and every
such motor vehicle so registered shall operate only on the
route and schedule set forth in said application during the
year for which said license is issued. It shall be the duty
of the Commissioner of Motor Vehicles, upon the presenta-
tion of a permit from the Public Service Commission of
Maryland, authorizing the motor vehicle owner to operate
on a certain route, to furnish the motor vehicle owner with
a distinguishing plate or marker. No such motor vehicle
owner shall change said schedule or route of his motor ve-
hicle during any year for which a certificate has been
issued, without a permit, in writing, made in duplicate,
from the Public Service Commission of Maryland, a copy
of which shall be sent to the Commissioner of Motor Ve-
hicles before said schedule is changed, whereupon a proper
readjustment of charges shall be made upon the basis
aforesaid. But nothing in this sub-title shall be construed
to prevent an owner or operator of such regularly licensed
vehicles from replacing in an emergency such vehicles
by a substitute vehicle in order to maintain the schedule
approved as herein provided or in an emergency from op-
erating, temporarily, reserve vehicles on such routes and
schedules, approved as aforesaid for the public accommoda-
tion. In cases where certificates have been issued to such
motor vehicle owner for more than one route, all motor
vehicles having the same number of passenger seats in-
cluding reserve or substitute vehicles, which have been reg-
istered for use upon either or any of said routes, may be
used interchangeably upon either or any of said routes.
