CHAPTER 787.
(Senate Bill 340)
AN ACT to repeal and re-enact, with amendments, Section
79 of Article 77 of the Annotated Code of Maryland
(1939 Edition), title "Public Education", sub-title
"Chapter 7. Schools", relating to the average attend-
ance of children which will authorize the employment
of additional teachers.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 79 of Article 77 of the Annotated
Code of Maryland (1939 Edition), title "Public Education",
sub-title "Chapter 7. Schools", be and it is hereby re-
pealed and re-enacted, with amendments, to read as fol-
lows:
79. Whenever a school numbers more than forty chil-
dren in average attendance, an assistant may be employed
by the county board of education, in their discretion; and
for every additional forty children, one teacher may be
appointed. Provided, however, that no school shall lose a
teacher until the average attendance falls below thirty-five
children in a two teacher school; below seventy children
in a three teacher school; or below one hundred and five
children in a four teacher school.
SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1943.

Code of Public Local Laws of Maryland, title, "Allegany
County, " sub-title, "City of Cumberland, " as enacted by
Chapter 96 of the Acts of 1922 of the General Assembly
of Maryland, and said new section to be known as "Sec-
