which said report shall be submitted monthly to the Mayor
and Council. Upon the request of the Council the said
justice shall produce his docket and may be placed under
oath and interrogated as to the entries therein. He shall
pay over to the clerk and treasurer of the Mayor and
Council, promptly, all fines and costs imposed and collected
by him, and shall issue written orders to the clerk and
treasurer for the payment of all fees and costs in all cor-
poration cases tried by him, and said fines shall be a part
of the revenue of the town.

(4) If the Trial Magistrate neglects to discharge any
of the duties imposed upon him by this charter or refuses
to pay over the fines and costs collected by him, as herein
directed, he shall be liable to indictment in the Circuit
Court for Frederick County, and upon conviction he shall
be fined the sum of fifty dollars or imprisoned in the county
jail for a term not exceeding three months, or both, in the
discretion of the court.

CHIEF OF POLICE

41. The chief of police shall be vested and clothed with
all the power and authority of a sheriff and any one resist-
ing him or interfering with him in the discharge of his
duties shall be liable, upon conviction in the Circuit Court
for Frederick County, or before the Trial Magistrate of
the town of Brunswick, in the same manner and to the
same extent as if he had resisted a sheriff; he shall assist
the Mayor in the enforcement of the ordinances, and to
that end it shall be his duty to make complaint to the Trial
Magistrate against any and every person violating any
ordinance of the town; he shall be executive officer of the
Mayor and Council, and shall serve, deliver or post any
order or notice that under any law or ordinance of the town
or under this Charter is to be served, delivered or posted,
and all returns made by the chief of police to the Mayor,
the Council or the Mayor and Council shall have the same
force and effect, and be entitled to and receive the same
credence as a return of a sheriff to any process in the circuit
courts of this State; it shall be his duty, as a peace officer
to maintain and preserve peace, good order and good con-
duct within the limits of said town and among all persons
found therein; he shall repress, prevent and put down
disorderly conduct and all disturbances of the public
peace, breaches of the peace, gambling of all kinds; the
unlawful sale of intoxicating drinks and any and all other
unlawful and criminal acts and conduct whatsoever within
the corporate limits of said town. Upon the application
