85. PENALTIES. Any person found guilty for violating any
of the provisions of Sections 2 to 84 inclusive of this Article
shall be deemed guilty of a misdemeanor, unless a penalty is
provided in a section above referred to, and upon conviction
before any Justice of the Peace of this State shall be fined not
less than Ten Dollars (#10. 00) nor more than Fifty Dollars
($50. 00) and costs for each and every offense, or sentenced to
jail until said fine and costs have been paid.
86. And be it further enacted, That the provisions of this
Article shall in no manner prevent the prosecution of persons
who have been arrested for violation of laws existing on the
statute books of this State prior to its enactment. The repeal
by this Article of any provisions of law shall not revive any
law heretofore repealed or superseded, nor shall any such re-
peal affect any act done, liability incurred, or any right ac-
crued or vested, or affect, or abate, or prevent any right or
penalty or punish any offense under the authority of such
repealed laws.
PART 2.
GAME AND FRESH WATER FISH.
87. DEFINITIONS. Whenever used in this Article, unless a
counter-intention is evident from the context, the term "non-
tidal Waters" shall embrace all waters above a point where
the tide ebbs and flows.
The word "person" shall include Corporation, Partnership,
and Joint Association.
The term "Game and Fresh Water Fish" shall include all
fishes of all species found in all waters above a point where
the tide ebbs and flows including ponds, lakes, canals, pub-
licly or privately owned, and all waters of the Conowingo Pool
lying within the boundary lines of Maryland, and the waters
of Deep Creep Lake.
88. For the purpose of defining the lines between tidal and
non-tidal waters, said lines shall be as follows:
Susquehanna Elver: A line drawn direct from the northern-
most point of the mouth of Deer Creek in Harford County
in an easterly course to Granite Lodge in Cecil County.
Harford County
Winter's Run: Dam located one-half mile south of the Phila-
delphia Road.
