1004 LAWS OF MARYLAND. [CH. 708

of a State Game Refuge is used for a State Park entry by any
person within the refuge area for recreational pursuits shall
not be restricted on the portion of said territory used as a
State Park so long as such persons do not carry fire-arms or
traps or do not permit dogs to disturb or chase game.

The Game Warden by written permission may grant to re-
sponsible persons the right to hunt or trap for vermin and to
use dogs and guns in connection therewith on State Game
Refuges or may grant permission to trap birds or game animals
which, when so trapped, shall be used for propagation pur-
poses.

82. PENALTIES. Any person convicted before any Justice of
the Peace of this State for violating any of the provisions of
this sub-title or any of the rules and regulations formulated
and made by the Game Warden in accordance with the pro-
visions thereof, whether the same be trespassing on any refuge
or other provision of said sub-title, shall be fined not less than
Twenty-Five Dollars ($25. 00) nor more than Fifty Dollars
($50. 00) and costs for each and every offense.

ELK AND DEER,

83. It shall be unlawful for any person to hunt, pursue, or
kill any female doe or fawn of the elk or deer family within
the State of Maryland at any time; however, it shall be lawful
to hunt, pursue, or kill any male deer or male elk with two or
more points to one antler during any open season as provided
by law. No person shall kill or attempt to kill a second elk or
deer in any one season or have in possession more than one
male deer or male elk killed in this State during any one year.

Every person killing an elk or deer found in a wild state
shall, within twenty-four hours report said kill to a salaried
Deputy Game Warden and write the State Game Warden
giving name, address, hunter's license number, county, and
location where said elk or deer was killed.

(a) It shall be unlawful to hunt in any manner any elk or
deer except through the use of a gun propelling one all-lead or
lead-alloy or soft-nosed or expanding bullet or ball at a single
discharge. It shall be unlawful to hunt or shoot at any elk or
deer with a rifle using cartridges giving a mizzle energy of less
than 1200 foot pounds, however, it shall be lawful to hunt or
kill an elk or deer with bow and arrow. It shall be unlawful
for any person at any time to shoot at or kill, or wound, or
capture either an elk or deer while same is taking refuge in or
swimming through the waters of any stream, pond, or lake.
