from loaning moneys upon real estate security as provided by
law. Nothing in this section shall affect the title to or holding
by any bank or trust company of any real or leasehold estate
now owned by said bank or trust company, and nothing herein
shall affect the rights of banks or trust companies to purchase
and hold land or real or leasehold estate as trustee or in other
fiduciary capacity.

SEC. 2. And be it further enacted, That this Act shall take
effect on June 1, 1941.

CHAPTER 405.
(House Bill 438)

AN ACT to add one new section to Article 16 of the Code of
Public Local Laws of Maryland (1939 Edition), title "Mont-
gomery County", sub-title "County Commissioners and
Treasurer", said new section to be known as Section 198B,
to follow immediately after Section 198A of said Article,
relating to actions against the County Commissioners for
injury or damage to person or property.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That one new section be and it is hereby added to Article
16 of the Code of Public Local Laws of Maryland (1939 Edi-
tion), title "Montgomery County", sub-title "County Com-
missioners and Treasurer", said new section to be known as
Section 198B, to follow immediately after Section 198A of
said Article, and to read as follows:

198B. No action shall be maintained against the Board of
Commissioners of Montgomery County for unliquidated dam-
ages for any injury or damage to person or property unless

(1) within ninety days after the injury or damage was sus-
tained, the claimant, his agent or attorney, gave notice in
writing to the County Commissioners of the approximate time,
place, cause and circumstances of such injury or damage or

(2) a report in writing concerning the events causing the in-
jury or damage was made by a State or county police officer
in the regular course of duty.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 3941.
