added to Article 73B to be known as sections 1 to 14, inclusive,
and to read as follows:
ARTICLE 73B—PENSIONS
1. Definitions. The following words and phrases as used
in this Article, unless a different meaning is plainly required
by the context, shall have the following meanings:
(1) "Retirement system" shall mean the Employees' Retire-
ment System of the State of Maryland as defined in Section
2 of this Article.
(2) "Department" shall mean any agency of the State
Government receiving State appropriations and employing
persons who are, or who are entitled to become, members of
the retirement system.
(3) "Employee" shall mean any regular classified or un-
classified officer or employee of the State for whom compensa-
tion is provided for by State appropriation, or whose com-
pensation is paid from State funds. The term "employee"
shall include any appointed or elected employee of the State,
and any clerk of court and register of wills, and shall include
the sheriff of Baltimore City and the employees of his office.
It shall exclude any person who is a member of or eligible to
membership in the Teachers' Retirement System of the State of
Maryland or the State Police Pension Fund or the Judges Re-
tirement System and any class of employees whose compensa-
tion is only partly paid by the State or who are serving on a
temporary or other than per annum basis. In all cases of doubt,
the Board of Trustees, provided for in Section 6 of this Article,
shall determine whether any person is an employee as defined
in this Article, irrespective of the method of payment.
(4) "Member" shall mean any employee included in the
membership of the retirement system as provided in Section 3
of this Article.
(5) "Board of Trustees" shall mean the board provided for
in Section 6 of this Article to administer the retirement
system.
(6) "Medical Board" shall mean the board of physicians
provided for in Section 6 of this Article.
(7) "Service" shall mean service as employee paid for by
the State.
(8) "Prior service" shall mean service rendered prior to the
date of establishment of the retirement system for which credit
is allowable under Section 4 of this Article.
(9) "Membership service" shall mean service as an employee
rendered while a member of the retirement system.
(10) "Creditable service" shall mean prior service plus
membership service for which credit is allowable as provided
in Section 4 of this Article.
