58M. Registration or Discharge. The Governor is author-
ized to accept the resignation of any officer or to grant a
discharge to any enlisted man at any time in his discretion.

58N. Articles of War; Freedom from Arrest.

(a) Whenever such forces or any part thereof shall be
ordered out for active service, the provisions of law govern-
ing the organized militia of this State relating to courts
martial, their jurisdiction and the limits of punishment and
the rules and regulations prescribed thereunder, shall be in
full force and effect.

(b) No officer or enlisted man of such forces shall be
arrested on any warrant, except for treason or felony, while
going to, remaining at, or returning from a place where he is
ordered to attend for military duty.

SEC. 2. And be it further enacted by the General Assembly
of Maryland, That if any provision of this Act or the applica-
tion thereof to any person or circumstances is held invalid,
such invalidity shall not affect other provisions or applica-
tions of the Act which can be given effect without the invalid
provision or application, and to this end the provisions of
this Act are declared to be severable.

SEC. 3. And be it further enacted, That if any clause, sen-
tence, paragraph, or section of this sub-title shall, for any
reason, be adjudged by any court of competent jurisdiction to
be unconstitutional and invalid, such judgment shall not
affect, impair or invalidate the remainder thereof, but shall
be confined in its operation to the clause, sentence, paragraph,
or section thereof so found unconstitutional and invalid.

SEC. 4. And be it further enacted. That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health, morals, safety and
welfare, and upon being passed by a yea and nay vote sup-
ported by three-fifths of all of the members elected to each of
the two Houses of the General Assembly, the same shall take
effect from the date of its passage.
