thereof, shall be held unconstitutional, such unconstitutional-
ity shall not affect the validity of the remaining parts of this
Act. The Legislature hereby declares that it would have
passed the remaining parts of this Act if it had known such
clause, sentence, part or provision thereof should be declared
unconstitutional.
SEC. 3. And 'be it further enacted, That this Act shall take
effect June 1st, 1941.

CHAPTER 251.
(House Bill 414)
AN ACT to add a new section to Article 16 of the Code of
Public Local Laws of Maryland (1939 Edition of said Arti-
cle), title "Montgomery County", sub-title "Police", said
new section to be known as Section 800A and to follow im-
mediately after Section 800 of said Article, to authorize and
empower the County Commissioners of Montgomery County
in any period of emergency to appoint temporary police
officers in said county.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
16 of the Code of Public Local Laws of Maryland (1939 Edi-
tion of said Article), title "Montgomery County", sub-title
"Police", said new section to be known as Section 800A, to
follow immediately after Section 800 of said Article, and to
read as follows:
800A. Whenever it shall appear to the Board of County
Commissioners of Montgomery County that the public safety
requires additional police protection for the preservation of
the peace or the adequate enforcement of law, they may in
their discretion appoint such number of police officers for
periods not to exceed sixty (60) days and may re-appoint such
police officers for such additional sixty (60) day periods as
may in their discretion be necessary for the public welfare;
said temporary police officers so designated shall take the
oath provided by law for deputy sheriffs and shall, during
the time of their appointment, have all the powers of a regular
member of the Montgomery County police force, and shall have
all the powers possessed by deputy sheriffs of the State of
Maryland under the general law of the State insofar as such
