30 years. It would make possible the payment of 60% of the
salary for those who have served 40 years.

The Police Commissioner recommends that this Bill be
vetoed.

In a written communication to me the Commissioner stated
that he declined to give approval for the introduction of the
Bill. He also pointed out that under the Bill already signed
(chapter 427), permission is given the City to include members
of the Police Department in the retirement system. The Com-
missioner asserts that at a time when efforts are being made to
put the Police Pension Fund on an actuarial basis, it would be
unfortunate to have this measure passed. He also points out
that tinder the terms of this Bill, the allowance would be
retroactive and would include members heretofore retired.

The Committee representing Mayor Jackson also registers
its opposition to this Bill. Accordingly, the chances of favor-
able action on the inclusion of the police in the City system
might be affected if this Bill is signed.

The Police Commissioner strongly recommends its veto and
in view of the above circumstance, I will disapprove it.

Chapter 772 (House Bill 79); Chapter 231 (Senate Bill 95).
Under the terms of these Bills, additional leave of absence with
pay is ordered to be granted to members of the Police Depart-
ment of Baltimore City for all over-time work performed on
order of the Police Commissioner, except in cases of emergency.

Since the adjournment of the Legislature, the Police Com-
missioner has written me the following letter with respect to
these measures:

"Senate Bill No. 95, which became Chapter 231, and
House Bill No. 79, which became Chapter 772, provide
that additional leave of absence shall be granted to
members of the force for all overtime work which they
perform on order of the Police Commissioner, except
in cases of emergency.

"Members of the force are never required to per-
form extra duty except in cases of emergency, and in
the circumstances, I recommend that these Bills be
vetoed. (Signed) Robert F. Stanton, Commissioner. "

Inasmuch as the head of the Department states that all
overtime work is of an emergency nature, there is no necessity
for my signing the measure in question. I feel constrained to
follow the recommendation of the head of the Department and
veto the Bills.

The Committee representing Mayor Jackson also voiced its
opposition to these measures.
