CHAPTER 133.

(Senate Bill 277)

AN ACT to repeal and re-enact, with amendments, Sec-
tion 261 of Article 23 of the Code of Public Local Laws
of Maryland (1930 Edition), title "Wicomico County",
sub-title "Salisbury", as said section was amended by
Chapter 57 of the Acts of 1935, relating to the terms of
office of the Mayor and Councilmen.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 261 of Article 23 of the Code of
Public Local Laws of Maryland (1930 Edition), title
"Wicomico County", sub-title "Salisbury", as said section
was amended by Chapter 57 of the Acts of 1935, be and it
is hereby repealed and re-enacted, with amendments, to
read as follows:

261. The Government of said City shall be vested in a
Mayor and five Councilmen, to be selected as hereinafter
provided, who shall be taxpayers and qualified voters of
the City for twelve months next preceding their election,
and shall hold their offices respectively, for the term of
four years or until their successors are appointed or elected
and qualified; that nothing in this or the next succeeding
Section shall affect the tenure of office, rights, duties or
powers of any officer of the said City now holding office,
or of the three Councilmen to be elected in the year 1941,
who shall hold office for terms of three years or until their
successors are appointed or elected and qualified.

SEC. 2. And be it further enacted, That this Act is here-
by declared to be an emergency law and necessary for
the immediate preservation of the public health and safety,
and being passed by a yea and nay vote, supported by
three-fifths of all of the members elected to each of the
two Houses of the General Assembly, the same shall take
effect from the date of its passage.
