shall be maintained thereafter by the Commission free of
tolls; provided, however, that the Commission may thereafter
charge tolls for the use of the motorway in the event that tolls
are required for maintaining, repairing and operating the
motorway due to the lack of funds from sources other than
tolls.
122-1. The Commission is hereby authorized to expend out
of any funds available for the purpose such moneys as may be
necessary for the study of the motorway and the Commis-
sion is hereby authorized to use its engineering1 and other
forces and consulting engineers and traffic engineers for
the purpose of effecting such study and to pay for such ad-
ditional engineering and traffic and other expert studies as
it may deem expedient. The Commission shall have power
and authority to make and enter into all contracts and agree-
ments necessary or incidental to the performance of its duties
in the execution of its powers under this sub-title, and to
employ engineering, architectural and construction experts
and inspectors and attorneys, and such other employees as
may be necessary in its judgment, and fix their compensation.
All such expenses incurred by the Commission prior to the
issuance of revenue bonds under the provisions of this sub-title,
shall be paid by the Commission and charged to the motor-
way, and the Commission shall keep proper records and ac-
counts showing each amount so charged. Upon the sale of
revenue bonds for the motorway, the funds so expended shall be
reimbursed to the Commission from the proceeds of such bonds
for the amounts so paid and charged. Except as herein pro-
vided, no liability or obligation shall be incurred hereunder
beyond the extent to which money shall have been provided
under the authority hereof.
122J. Any holder of revenue bonds issued under the pro-
visions of this sub-title or any of the coupons attached thereto,
and the trustee under the trust indenture, if any, except to
the extent the rights herein given may be restricted by resolu-
tion passed before the issuance of the bonds or by the trust
indenture, may either at law or in equity, by suit, action,
mandamus, or other proceedings, protect and enforce any and
all rights under the laws of the State of Maryland or granted
hereunder or under such resolution or trust indenture, and
may enforce and compel performance of all duties required
by this sub-title, or by such resolution or trust indenture, to
be performed by the Commission, or any officer thereof, in-
cluding the fixing, charging, and collecting of tolls for the
use of the motorway.
