122C. The Commission is hereby authorized to purchase
within the State, and within any municipality (including
Baltimore City) and within any other political subdivision of
the State, and within the limits of any property owned or
controlled by the United States Government or any agency
thereof, solely from funds provided under the authority of this
sub-title such lands, structures, rights-of-way, franchises, ease-
ments, and other interests in lands, including lands under water
and riparian rights of any such owner or owners deemed neces-
sary for the construction of the motorway, upon such terms
and at such prices as may be considered by it to be reasonable
and can be agreed upon between it and the owner thereof, and
to take title thereto in the name of the State of Maryland. The
Commission may utilize such portion of any existing highway
in the State as may be deemed necessary by it for the estab-
lishment of the motorway; provided that such portion of any ex-
isting highway so utilized, shall be replaced by a section of
highway of approximately the same length to provide for the
alternate toll free route, the cost to be provided as outlined in
Section 122B (sub-section e). All municipalities (including Bal-
timore City), counties and other political subdivisions or pub
lie agencies and commissions of the State, notwithstanding any
contrary provision of law, are hereby authorized and empow-
ered to transfer jurisdiction over, to lease, lend, grant or con-
vey, to the State upon the request of the Commission, upon
such terms and conditions as the proper authorities of such
municipalities, counties or other political subdivisions or pub-
lic agencies and commissions of the State may agree with the
Commission as reasonable and fair, such real or personal
property as may be necessary or desirable in establishing
or constructing the motorway, including public roads and other
property already devoted to public use; provided that such
portion of any public roads and other property so utilized,,
shall be replaced by a section of highway of approximately
the same length, and by property of the same kind to provide
for the alternate toll free route, the cost to be provided as
outlined in Section 122B (sub-section e).
Whenever a price cannot be agreed upon, or whenever
the owner is legally incapacitated or is absent or is unable
to convey valid title or is unknown, the Commission is hereby
authorized and empowered to acquire by condemnation or by
the exercise of the power of eminent domain any lands, prop-
erty, rights, rights-of-way, franchises, easements and other
property of any person, copartnership, association, railroad
or other corporation, or municipality (including Baltimore
City) or political sub-division deemed necessary or convenient
for the establishment or construction or the efficient operation
of the motorway or necessary in the restoration of public or pri~
