out a license. Any person, firm or corporation selling goods
without a license as required by law, shall be guilty of a mis-
demeanor, and, upon conviction thereof, shall be fined not ex-
ceeding $100 or imprisoned for not more than thirty days; the
penalty herein prescribed not to affect the penalty which may
be prescribed by existing law for the violation of special pro-
visions of the license laws.

SEC. 3. And be it further enacted, That a new section be
and the same is hereby added to Article 81 of the Annotated
Code of Maryland (1939 Edition), title "Licenses", sub-title
"Mode of Issuing—General Provisions", said new section to
follow immediately after Section 8 of said Article, to be known
as Section 8A, and to read as follows:

8A. Except as otherwise expressly provided in this Article
no county, city or other political sub-division of this State
shall require any person, firm or corporation to obtain a per-
mit or license to transact in such county, city or other political
sub-division, any business or occupation for which it or he is
required to obtain a State license under the provisions of this
Article, nor shall any county, city or other political sub-
division of this State levy any occupational tax or fee upon
such person, firm or corporation for transacting any such
business or engaging in any such occupation for which such
State license is required. Notwithstanding the provisions of
this section, any county, city or other political sub-division of
this State may require permits or licenses to be obtained where
necessary for regulatory purposes in the interest of the public
health, safety or morals. The provisions of this section shall
not be deemed to be repealed by any local Act hereafter passed
unless expressly referred to and expressly repealed in terms.

SEC. 4. And be it further enacted, That Section 9 of Article
56 of the Annotated Code of Maryland (1939 Edition), title
"Licenses", sub-title "Auctioneer", be and the same is hereby
repealed and re-enacted, with amendments, to read as follows:

9. Every person who shall open a room or place of busi-
ness for the purpose of selling goods, wares and merchandise
at auction shall be required to take out a license in the same
manner as resident traders; the amount to be charged for said
license to be rated upon the amount in value of goods, wares
and merchandise on hand by said person for sale in the same
manner as licenses are rated to resident traders. Any county
or city of this State may require additional local licenses for
persons selling goods at auction.

SEC. 5. And be it further enacted, That Section 43 of Article
56 of the Annotated Code of Maryland (1939 Edition), title
