and Prince George's Counties, the purpose of the amend-
ment being to remove the provision that neighboring prop-
erty owners or occupants be required to prove special dam-
age in order to institute proceedings to restrain violations of
the said chapter or regulations adopted thereunder.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 26 of Chapter 714 of the Laws of Mary-
land of 1937, be and the same is hereby repealed and re-enacted
with amendments, so as to read as follows:

SECTION 26. And be it further enacted. That the construc-
tion, reconstruction., erection, structural alteration or use of
any building or other structure or the use of land or premises
in violation of any of the provisions of this Act or of any of
the provisions of any regulation enacted under this Act or
of any decision made under this Act is hereby declared to be
a misdemeanor. The wilful issuance of a building, use or oc-
cupancy permit in violation of any such provision or decision
is hereby declared to be a misdemeanor. The Commission, the
Board of County Commissioners of Montgomery or Prince
Georges County or the prosecuting official of either of said
counties may prosecute any such violation; and, in addition
to all other remedies provided by law, the Commission, said
Boards of County Commissioners, and public official of any
municipality or political subdivision within the District, or
any neighboring property owner or occupant (who would
be specially damaged by any such violation) may institute
injunction, mandamus or other appropriate action or pro-
ceeding to prevent such unlawful construction, reconstruction,
erection, alteration or use, and any court of competent juris-
diction is hereby granted jurisdiction to issue restraining
orders and temporary or permanent injunctions or mandamus
or other appropriate forms of remedy or relief.
