of the State, fixing the season for the catching of shad and
herring in such waters, prescribing the powers and duties
of the Conservation Commission, and fixing penalties for vio-
lation of this Act.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 28, 29, 30, the sub-title "Nets and Seines",
and Sections 48, 49, 50, 59, 60, 61, 62, 63 and 64 of Article 39
of the Annotated Code of Maryland (1939 Edition), title "Fish
and Fisheries", sub-title "Tidal Waters", be, and the same are
hereby repealed and enacted in lieu thereof fifteen new Sec-
tions to be known as Sections 28, 29, 30, 30A arid SOB, to fol-
low immediately after Section 27 of said Article, and Sections
59, 60, 61, 62, 63, 63A, 63B, 630, 63D and 64 of said Article,
to follow immediately after Section 58 of said Article, and to
read as follows -

28. Method of Fishing, (a) It shall be unlawful to take or
catch fin fish for any purpose in the tidal waters of this State
by the use of a gig or gig iron, or by the use of any purse net,
buck net, beam trawl, otter trawl, trammel net, troll net or
drag net.

(b) It shall be unlawful to take or catch fin fish for com-
mercial purposes (except eels) in the tidal waters of this State
by the use of any net or other device, except hook and line,
dipnet operated by hand, or fyke or hoop net less than 40 yards
in length, unless he is the holder of a license to operate the
same duly issued by the Conservation Commission, as herein-
after provided.

(c) It shall be unlawful for the Conservation Commission
to license the use of any net or other device for catching
fin fish for commercial purposes in the tidal waters of this
State, except the following: pound net, haul seine, and fyke or
hoop net more than 40 yards in length, and gill net more than
100 yards in length.

29. Regulation of Pound and Stake Nets, (a) It shall be
unlawful to set or use any pound or stake net or any line of
such nets which (1) has a greater length than one-third the
distance across the waters of the bay, sound, river, creek, cove
or inlet where it is set or (2) is so set or used as to impede or
obstruct navigation on or to block in any way the main
channel of such bay, sound, river, creek, cove or inlet.

(b) No pound or stake net shall at any time be set or used
closer to another pound or stake net than 400 yards, measured
at right angles to the line of stakes.

(c) Between successive pound or stake nets in the same row
clear and unobstructed intervals of at least 200 feet shall be
maintained. No single line of net stakes, including the pound
